AOI - Sponsored Bill to Protect Taxpayer Records During Appeals Advances

Taxpayers filing appeals in the Oregon Tax Court will have a better shot at preventing their confidential business records, tax returns, and documents containing trade secrets from being disclosed under an AOI-sponsored bill unanimously approved by the Senate Finance and Revenue Committee this week.
SB 609, introduced at the request of AOI, allows the tax court to issue protective orders for taxpayer records introduced at trial as well as requested during pre-trial discovery. The bill also creates an additional avenue for either party to appeal a tax court magistrate’s decision granting or denying a protective order. Under current law, such appeals must be taken directly to the Supreme Court. SB 609, as amended, allows the magistrate’s decision to be appealed first to the regular division of the tax court, and then, if necessary, to the state supreme court.
SB 609 will likely be considered by the full Senate next week. It will then advance to the House for referral and consideration by the House Revenue Committee.
